These Terms of Use (“Terms”) govern the use of the website www.ebookaplace.com and any affiliated website (“Ebookaplace.com”) owned by Ebookaplace Pty Ltd (“Ebookaplace”). Your use of this website means you accept these Terms. These terms, the policies referred to herein and any other terms explicitly referred to contain the complete terms and conditions that apply to your use of Ebookaplace.com and any affiliated websites (“the Website”).

USE OF THE SERVICES AND EBOOKAPLACE.COM CONSTITUTES KNOWING ACCEPTANCE AND ACKNOWLEDGEMENT OF THESE TERMS AND EBOOKAPLACE’S PRIVACY POLICY.

Ebookaplace may modify these Terms at any time without notice. Continued use of Ebookaplace.com after a change to these Terms, a change in the Privacy Policy, or after implementation of any other new policy constitutes acceptance of such change or policy.

1.0 Use of Ebookaplace.com by Customers

Summary of Service – Ebookaplace.com provides a secure, online booking system connecting customers and third party businesses. Customers agree to use the Ebookaplace.com to peruse third party business availability and at their discretion, make a booking for a given date and time. Customers acknowledge that information provided on Ebookaplace.com is provided on an “as is” basis and without any warranties whatsoever, including but not limited to accuracy or availability. Customer acknowledges and agrees that Ebookaplace has no affiliation with the third party businesses listed on Ebookaplace.com and makes no representations or warranties as to the third party businesses, including but not limited to availability, quality of product and service. Customer agrees that Ebookaplace has no liability for customers’ experiences with third party businesses booked through Ebookaplace.com.

1.1 Bookings

In response to your online request, Ebookaplace.com directly contacts the third party business’s computerised database of reservations. The availability of reservations is determined at the time of your query. Once you make a reservation, Ebookaplace.com will provide confirmation of the reservation to you by email. By using Ebookaplace.com, you agree to receive reservation confirmations by email after booking a reservation through Ebookaplace.com.

1.2 No Show Policy

Ebookaplace is committed to providing superior quality services to you and our third party business customers. To assist us in maintaining a consistently high level of service with participating third party businesses and their patrons, subject to clause 1.3, you are required to cancel any reservations that you will be unable to honour at least 120 minutes (2 hours) in advance on the day of the reservation. Note that any cancellations or changes to bookings (see clause 1.3) must be done in accordance with the policies of the third party business.

1.3 Changes to Bookings

If you want to change any details of your booking, you must contact the third party business directly. In some circumstances, you may cancel a booking entirely (subject to the policies of the relevant third party business). We will do our best to assist you, but cannot guarantee that changes can be made. Please note that:

  • bookings at certain third party businesses, or in certain time periods, or for certain types (e.g. function room) cannot be cancelled or changed; and
  • some third party businesses may permit cancellations or changes but this may involve that third party business provider imposing a charge,
and this information will be displayed (see cancellation policy) on the relevant third party business booking page, which you may access prior to making a booking.

In addition, we may apply an administration charge to all booking changes and permitted cancellations – this amount is displayed on the booking page (this is in addition to any cancellation charges imposed by the third party business).

If you fail to cancel a booking and do not honour the booking you have made, you will be charged for up to the full amount of the booking made.

1.4 Cancellation of Booking

Third party businesses may cancel your booking at any time prior to the booking time. In such a case, the third party business will make every effort to contact you and advise you of such. Ebookaplace accepts no responsibility if the third party business does not contact you.

1.5 Requirements at Third Party Business

We do not take your credit card details and as such you will be required to provide payment for your meal at the third party business. Ebookaplace takes no responsibility for third party business costs and is not liable in any way to any user of Ebookaplace.com for costs incurred with the third party business.

In addition, to eliminate identity fraud, the third party business may ask you to provide photo ID when you arrive to ensure that your identity matches the booking identity. A record and/or copy of this photo ID may be retained by the third party business to minimise the risk of fraudulent credit card usage and for verification purposes with your credit card provider in the event of dispute. This identification information may be supplied to us by the third party business.

1.6 Fairness

Ebookaplace tries to settle any issues, complaints or disputes quickly and fairly. Any correspondence regarding such matters should be sent to info@ebookaplace.com

2. Use of Ebookaplace.com by Third Party Businesses

Access and use of this website by third party businesses is governed by these Terms and our Master Subscription Agreement. In the event of conflict or inconsistency, the latter will prevail.

3. General Terms and Conditions Applicable to All Users/Visitors of Ebookaplace.com

3.1 Intellectual Property Rights

The material contained on these web sites is protected by copyright. You may use these web sites only for your personal and non-commercial purposes. Except to the extent permitted by relevant copyright legislation, you must not use, copy, modify, transmit, store, publish or distribute the material on these web sites, or create any other material using material on these web sites, without obtaining the prior written consent of Ebookaplace.
